These Terms of Service (“Terms”) govern your use of the website castleexterminators.co and the pest control services provided by Castle Exterminators, LLC (“Castle,” “we,” “us,” or “our”). By visiting our website, requesting an inspection, or receiving service, you agree to these Terms.
1. About Us
Castle Exterminators, LLC is a North Carolina limited liability company operating as a licensed structural pest control business (NC License #1979PW) with a mailing address of PO Box 15554, Durham, NC 27704. We serve Durham, Chapel Hill, Raleigh, Cary, and surrounding Triangle communities.
2. Service Requests & Estimates
An inspection request submitted through our website or by phone is a request for a quote, not a contract. A binding agreement is formed only when we accept your request in writing (email, text confirmation, or service agreement) and provide you with a scheduled service date and price. Estimates are valid for 30 days unless stated otherwise.
3. Payment
- Prices for recurring plans (quarterly general pest, monthly mosquito, etc.) are billed per visit unless we’ve agreed otherwise.
- Payment is due at the time of service unless we’ve invoiced you separately.
- Late payments over 30 days may accrue a 1.5% monthly finance charge (18% APR) or the maximum permitted by NC law, whichever is lower.
- Returned checks or failed card payments may incur a $25 fee.
4. Service Guarantee & Warranty
We stand behind our work. Between scheduled visits on a recurring plan, if the covered pest returns, we’ll re-treat at no additional charge. Termite warranties are governed by a separate written agreement.
Limitations: Our guarantee does not cover:
- Pests not covered by your specific plan (see your service agreement).
- Structural conditions we identified but you chose not to correct (moisture issues, exclusion work, sanitation).
- New infestations resulting from changes in the environment (new landscaping, remodeling, neighbor activity).
- Wildlife, bed bugs (unless separately contracted), or bees (we refer to local Durham beekeepers).
5. Access & Property Preparation
You are responsible for providing reasonable access to your property, notifying us of pets, small children, medical conditions, or occupants with sensitivities to pesticides, and preparing your home per any pre-treatment instructions we provide. If we cannot service due to lack of access, a missed-appointment fee may apply.
6. Cancellation
You may cancel a recurring plan at any time with at least 7 days’ written notice before your next scheduled visit. There are no long-term contracts and no cancellation fees. Any prepaid amount for services not yet delivered will be refunded.
7. Disclaimers & Limitation of Liability
WE PROVIDE PEST CONTROL SERVICES “AS IS.” TO THE FULLEST EXTENT PERMITTED BY LAW, CASTLE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, EXCEPT AS EXPRESSLY STATED IN A WRITTEN SERVICE AGREEMENT.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO OUR SERVICES IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
Nothing in these Terms limits liability that cannot be limited under NC law, including for gross negligence, willful misconduct, or personal injury caused by our negligence.
8. Insurance
Castle Exterminators, LLC maintains general liability and commercial auto insurance through West Bend Mutual Insurance. Certificates of insurance are available on request.
9. Website Use
- You may use our website for personal, non-commercial purposes to learn about our services and request an inspection.
- You may not scrape, copy, or republish content without written permission.
- All logos, text, photography, and site design are © Castle Exterminators, LLC unless otherwise noted.
10. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. Any dispute not resolved through arbitration (see below) shall be brought exclusively in the state or federal courts located in Durham County, North Carolina, and you consent to their jurisdiction.
11. Arbitration Agreement & 30-Day Opt-Out
Please read this section carefully — it affects your legal rights.
Any dispute, claim, or controversy arising out of or relating to these Terms or our services (except for small-claims-court matters and disputes about intellectual property) shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in Durham, North Carolina, or by video conference at your option. The arbitrator’s decision is final and enforceable in any court of competent jurisdiction.
Class-action waiver: Disputes must be brought on an individual basis, not as part of a class or representative action.
30-day opt-out right: You may opt out of this Arbitration Agreement by sending written notice to services@castleexterminators.co or to PO Box 15554, Durham, NC 27704 within 30 days of first becoming a customer or of the effective date of these Terms, whichever is later. Your notice must include your full name, service address, and the words “OPT OUT OF ARBITRATION.” Opting out will not affect any other part of these Terms.
12. Communications Consent (TCPA)
By providing your phone number to Castle, you consent to receive calls and text messages from us about your inspection, appointments, invoices, and service. Message and data rates may apply. You may opt out of texts by replying STOP. We do not send marketing texts using an automatic telephone dialing system without your prior express written consent.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated “Last updated” date. Continued use of our website or services after the change constitutes acceptance.
14. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force.
